By purchasing services, you confirm that you and any guests you have purchased for have read, understand, and agree to the following terms, conditions, and policies.

Cancellations, Charges, and Refund Policy

There is a 3.0% Bank Transaction  FEE for ALL refunds.  Credits in place of refunds for future sessions may be given at our discretion. Appointments canceled without 48-hour notice will incur a 50% charge. Personal or Group Programs, Retreats, Workshops, and Special Events require 7 days advance notice for refund requests. Event fees for tickets are non-refundable and refunds will incur a refund fee equal to the event fee + 3.0% bank transaction fee.  No refunds for sessions not used or no-shows or without 7 day advance notice of event/program/appointment start.  No refunds or credits for programs, workshops or retreats once they've begun. Please see any details in the event or service description you are purchasing.

Limitation and Assumption of Risk

I acknowledge that participation in meditation, yoga classes, workshops, or events offered by RMGJ can involve physical activity that may carry the risk of injury. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any program. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in these activities.

In consideration of being permitted to participate in classes or related activities, I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in the program. This includes, but is not limited to, injuries that may result from the use of props or equipment, adjustments or modifications by the instructor, or from participation in the class while pregnant or with a pre-existing condition.

I knowingly, voluntarily, and expressly waive any claim I may have against RMGJ its owners, instructors, employees, and representatives for injury or damages that I may sustain as a result of participating in classes or events.

Attending classes in person or online, you release RMGJ LLC from any and all damages that may result from such participation. You accept all risks, foreseeable and unforeseeable arising from such participation. You agree that RMGJ LLC will not be held liable for any damages of any kind resulting or arising from including but not limited to - direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of online services. You agree that the use of services is at your own risk.Rocky Mountain Gong Journeys LLC has no liability for loss incurred by you whether financial or otherwise.

Gong Contraindications/Considerations

May not be suitable for pregnancy, people with pacemakers or other implants, those suffering from serious heart conditions, acute or serious mental health problems, or those who may suffer from sound-induced epilepsy. If you are in any doubt about your suitability to attend these sessions, please consult your medical practitioner for advice. RMGJ LLC cannot assess your suitability to participate. Skin/Facial Services: 

 I confirm I have addressed any health or skin concerns with my RMGJ LLC and medical provider if necessary before receiving the service(s). I give permission to the Service Provider named above to perform the service(s) we have discussed and will hold them harmless from any liability that may result from the service(s). I have given an accurate account of the questions asked, including all known allergies or prescription drugs or products I am currently ingesting or using topically. I understand the Service Provider will take every precaution to minimize or eliminate negative reactions. I am aware and understand that receiving any beauty service can, in some individuals, cause an allergic reaction, breakouts and/or temporary irritation. I fully understand that this reaction can occur at any time, even if I have received this service on previous occasions. In the event that I may have additional questions or concerns regarding my treatment or suggested home product/post treatment care, I will consult my Service Provider immediately.
I agree that this constitutes full disclosure, and that it supersedes any previous verbal or written disclosures. I certify that I have read and fully understand the above notice and that I have had sufficient opportunity for discussion to have any questions answered. I understand the services(s) to be provided and accept the risks. I do not hold the Service Provider responsible for injury resulting from any medical condition that was present but not disclosed when the service(s) was performed.

Notice of Filming and Photography - Community Sessions only Services

When you attend this event, you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to such recording media and its release, publication, exhibition, or reproduction. No personal recordings are allowed.

Mediation:

In the event of any dispute, claim, or controversy arising out of or relating to the services provided under this Agreement, including but not limited to its interpretation, performance, or breach, the parties agree to resolve the matter exclusively through mediation, in accordance with the terms set forth:1. Initiation of Mediation: Either party may initiate mediation by providing written notice to the other party, specifying the nature of the dispute. The receiving party must respond within 30 days from receipt of the notice, confirming their willingness to participate in mediation. 2. Selection of Mediator: The parties shall mutually agree on a qualified mediator within 30 days of the written notice. The mediator must be impartial and independent of the parties. Parties may agree on one mediator or two co-mediators. Each mediator is appointed jointly by the parties. 3. Location of Mediation: The mediation shall take place within a 20 mile radius of Fort Collins, Colorado. 4. Costs: The costs of the mediation, including the mediator's fees, shall be shared equally between the parties unless otherwise agreed in writing. 5. Confidentiality: All communications, negotiations, and documents exchanged during the mediation process shall be confidential and may not be used in any subsequent legal proceedings, except as required by law. 6. Resolution: The parties agree to make a good faith effort to resolve the dispute through mediation. If the dispute is resolved through mediation, the parties shall execute a written settlement agreement. The resolution of the dispute through mediation shall be final and binding on the parties. 7. Exclusivity: The parties agree that mediation is the sole and exclusive method of dispute resolution under this Agreement. No party shall resort to litigation, arbitration, or any other method of dispute resolution at any point during or after the mediation process.
